Terms of Service

By accessing or using DataViz, you agree to these Terms of Service. If you do not agree, do not use our platform.

1. Account Terms

You must be at least 18 years old and provide accurate registration information. You are responsible for maintaining the security of your account and all activities that occur under it. One person or legal entity may not maintain more than one free account.

2. Acceptable Use

You may not use DataViz to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit malware or attempt to gain unauthorized access
• Reverse engineer or decompile our software
• Use our service for competitive benchmarking without consent
• Store or process data that violates applicable privacy laws

3. Payment Terms

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly stated. We may change pricing with 30 days' notice. Failure to pay may result in account suspension.

4. Data Ownership

You retain all rights to your data. DataViz does not claim ownership of any data you connect or upload. We process your data solely to provide the service and as described in our Privacy Policy.

5. Service Level

We target 99.9% uptime for paid plans. Scheduled maintenance will be communicated 48 hours in advance. We are not liable for downtime caused by factors beyond our control.

6. Intellectual Property

DataViz and its original content, features, and functionality are owned by DataViz Inc. and are protected by international copyright, trademark, and other intellectual property laws.

7. Termination

You may terminate your account at any time. We may terminate or suspend access for violations of these terms. Upon termination, your right to use the service ceases immediately. We will make your data available for export for 30 days after termination.

8. Limitation of Liability

DataViz shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Changes to Terms

We may modify these terms at any time. Material changes will be communicated by email. Continued use after changes constitutes acceptance.

10. Governing Law

These terms are governed by the laws of the State of Delaware, USA. Any disputes shall be resolved through binding arbitration.
