Terms of Service

Welcome to DevForge. These Terms of Service ("Terms") govern your access to and use of DevForge's platform, APIs, and related services. By using our services, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using DevForge services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Services
DevForge provides a developer platform that includes:
- RESTful and GraphQL APIs for application development
- Software development kits (SDKs) for various programming languages
- Developer dashboard and analytics
- Webhook delivery and management
- Edge computing functions
- Documentation and support resources
3. Account Registration
3.1 Account Requirements
To use certain features of our services, you must create an account. You agree to:
- Provide accurate, current, and complete registration information
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
3.2 Account Restrictions
You may not:
- Create multiple accounts for abusive purposes
- Share account credentials with unauthorized users
- Transfer your account without our written consent
- Use another user's account without permission
4. API Usage and Rate Limits
4.1 API Keys
You are responsible for maintaining the confidentiality of your API keys. API keys should be treated as sensitive credentials and should never be:
- Shared publicly or committed to public repositories
- Embedded in client-side code
- Shared with unauthorized third parties
4.2 Rate Limits
Your API usage is subject to rate limits based on your subscription plan. Exceeding rate limits may result in:
- Temporary suspension of API access
- Additional charges for overage
- Account review or termination for repeated violations
5. Acceptable Use
You agree not to use our services to:
- Violate any applicable laws or regulations
- Infringe upon intellectual property rights
- Transmit malware, viruses, or harmful code
- Engage in unauthorized data collection or scraping
- Interfere with or disrupt service integrity
- Attempt to gain unauthorized access to systems
- Harass, abuse, or harm other users
- Send spam or unsolicited communications
- Engage in fraudulent or deceptive practices
6. Payment Terms
6.1 Billing
If you subscribe to a paid plan:
- Fees are billed in advance on a monthly or annual basis
- All fees are non-refundable except as required by law
- You authorize us to charge your payment method
- Prices may change with 30 days' notice
6.2 Overages
Usage exceeding your plan limits may result in additional charges at the rates specified in your plan documentation. We will notify you when approaching usage limits.
7. Intellectual Property
7.1 Our Intellectual Property
DevForge and its licensors own all rights to the services, including but not limited to software, APIs, documentation, trademarks, and content. These Terms do not grant you any rights to use our trademarks or branding.
7.2 Your Content
You retain ownership of content you submit through our services. By submitting content, you grant us a license to use, store, and process that content as necessary to provide the services.
7.3 Feedback
Any feedback, suggestions, or ideas you provide about our services may be used by us without obligation or compensation to you.
8. Service Level Agreement
For customers on paid plans, we commit to the following service levels:
- Uptime: 99.9% monthly uptime for API services
- Latency: p99 latency under 200ms for standard API calls
- Support: Response times as specified in your plan
Service credits may be available for downtime exceeding these commitments, as detailed in our SLA documentation.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- UNINTERRUPTED OR ERROR-FREE OPERATION
- ACCURACY OR RELIABILITY OF ANY CONTENT
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEVFORGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless DevForge and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the services
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit through the services
12. Termination
12.1 Termination by You
You may terminate your account at any time through your account settings or by contacting support. Upon termination, you remain responsible for any outstanding charges.
12.2 Termination by Us
We may suspend or terminate your access to the services at any time for:
- Violation of these Terms
- Non-payment of fees
- Conduct harmful to other users or our services
- Extended periods of inactivity
12.3 Effect of Termination
Upon termination:
- Your right to use the services immediately ceases
- We may delete your data after a reasonable retention period
- Provisions that should survive termination will remain in effect
13. Modifications to Terms
We may modify these Terms at any time. Material changes will be communicated via email or through the services with at least 30 days' notice. Continued use of the services after changes take effect constitutes acceptance of the modified Terms.
14. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in San Francisco County, California.
15. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and DevForge regarding the services.
- Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
- Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
- Assignment: You may not assign these Terms without our written consent.
