1. Agreement to Terms
By accessing or using SunPower Pro's services, website, or signing a solar installation contract, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
These terms apply to all visitors, users, customers, and others who access or use our services, including residential and commercial solar installations, maintenance services, and financing options.
2. Services Description
SunPower Pro provides solar energy system design, installation, and maintenance services. Our services include:
- Residential and commercial solar panel installation
- Battery storage system installation
- EV charger installation
- System design and engineering
- Permit acquisition and utility interconnection
- Ongoing maintenance and monitoring services
- Financing facilitation
3. Installation Contracts
Solar installation projects are governed by a separate Installation Agreement that includes:
- System specifications and equipment details
- Total project cost and payment schedule
- Installation timeline and milestones
- Warranty terms and conditions
- Performance guarantees
- Cancellation and refund policies
The Installation Agreement, when signed, supersedes these general terms for matters specifically addressed in that agreement.
4. Pricing and Payment
All quotes and pricing are valid for 30 days from the date of issuance unless otherwise specified. Final pricing may be adjusted based on:
- Site survey findings
- Structural requirements
- Electrical upgrades
- Permit fees and utility charges
- Changes in equipment availability or cost
Payment terms are specified in the Installation Agreement. Late payments may result in project delays and additional charges.
5. Warranties
SunPower Pro provides the following warranties:
Equipment Warranties
- Solar panels: 25-year manufacturer warranty
- Inverters: 10-25 year warranty (varies by model)
- Batteries: 10-year warranty
- Racking: 25-year warranty
Workmanship Warranty
10-year workmanship warranty covering installation quality and roof penetrations.
6. Performance Guarantees
We guarantee your system will produce the estimated energy output specified in your Installation Agreement, subject to:
- Normal weather variations
- Proper system maintenance
- No shading changes from new structures or tree growth
- System operating as designed
If your system underperforms by more than 10% over a 12-month period, we will investigate and remedy the issue at no cost during the warranty period.
7. Customer Responsibilities
As a customer, you agree to:
- Provide accurate property and utility information
- Maintain clear access to your roof and electrical systems
- Obtain necessary HOA approvals if applicable
- Not modify the solar system without authorization
- Report any system issues promptly
- Maintain adequate homeowner's insurance
- Allow periodic maintenance access
8. Permits and Regulations
SunPower Pro will obtain all necessary permits and ensure compliance with local building codes and electrical standards. However, we are not responsible for:
- HOA restrictions that prevent installation
- Changes in utility net metering policies
- Changes in tax credit or incentive programs
- Delays caused by permitting authorities
9. Limitation of Liability
To the maximum extent permitted by law, SunPower Pro's liability for any claim arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.
We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost savings, or business interruption.
10. Cancellation and Termination
You may cancel your contract within the timeframe specified in your Installation Agreement. Cancellation terms include:
- 3-day right of rescission after signing
- Full refund of deposits if cancelled before permit submission
- Pro-rated refund less expenses incurred after permit submission
- No refund after installation begins
11. Dispute Resolution
Any disputes arising from these terms or our services will be resolved through:
- Good faith negotiation between the parties
- Mediation by a mutually agreed mediator
- Binding arbitration in accordance with AAA rules
These terms shall be governed by the laws of the State of California.
12. Changes to Terms
We reserve the right to modify these terms at any time. Material changes will be communicated to customers with active projects or service agreements. Continued use of our services after changes constitutes acceptance of the modified terms.
