Terms of Service

1. Acceptance of Terms

By accessing or using DataForge's services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Services

DataForge provides a cloud-based data pipeline platform that enables users to build, deploy, and monitor ETL and real-time streaming pipelines. The Services include the DataForge web application, API, CLI tools, and related documentation.

3. Account Registration

To use the Services, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

4. Your Data

You retain all ownership rights to the data you process through DataForge ("Customer Data"). You grant us a limited license to process Customer Data solely to provide the Services. We will not access, use, or share Customer Data except as necessary to provide the Services or as required by law.

5. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose
  • Attempt to gain unauthorized access to the Services or related systems
  • Interfere with or disrupt the integrity or performance of the Services
  • Reverse engineer, decompile, or disassemble any part of the Services
  • Resell or redistribute the Services without authorization
  • Use the Services to process data that you do not have the right to process

6. Payment Terms

Paid plans are billed monthly or annually in advance. All fees are non-refundable except as required by law. We may change our pricing with 30 days' notice. Continued use of the Services after a price change constitutes acceptance of the new pricing.

7. Service Level Agreement

DataForge commits to 99.9% uptime for paid plans. If we fail to meet this commitment, eligible customers may receive service credits as described in our SLA documentation. The SLA does not apply during scheduled maintenance or circumstances beyond our reasonable control.

8. Intellectual Property

DataForge and its licensors retain all intellectual property rights in the Services, including all software, documentation, designs, and trademarks. These Terms do not grant you any rights to use DataForge's trademarks or branding.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATAFORGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

Either party may terminate these Terms at any time. Upon termination, your right to access the Services immediately ceases. We will make your Customer Data available for export for 30 days after termination, after which it will be permanently deleted.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.
