1. Acceptance of Terms
By accessing or using FoodDash's website, mobile application, or any of our services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the modified Terms.
2. Service Description
FoodDash provides an online platform that connects users with local restaurants for food ordering and delivery services. We facilitate orders between you and participating restaurants, and coordinate delivery through our network of independent delivery drivers ("Dashers").
- We are an intermediary platform, not a restaurant or food service provider
- Restaurants are responsible for food preparation and quality
- Delivery times are estimates and may vary based on conditions
- Service availability varies by location
3. Account Registration
To use certain features of our Service, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Be at least 18 years old or the legal age in your jurisdiction
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
4. Orders and Payments
4.1 Placing Orders
When you place an order, you make an offer to purchase from the restaurant. Orders are confirmed once accepted by the restaurant and payment is processed.
4.2 Pricing
Menu prices, delivery fees, service fees, and taxes are displayed before checkout. Prices may differ from restaurant dine-in prices. We reserve the right to adjust pricing at any time.
4.3 Payment
You authorize us to charge your selected payment method for order totals plus applicable fees and taxes. All payments are non-refundable except as stated in our Refund Policy.
5. DashPass Subscription
DashPass is our subscription service offering benefits including reduced or waived delivery fees. By subscribing:
- Your subscription automatically renews until canceled
- You may cancel anytime; benefits continue until the billing period ends
- Benefits apply to eligible orders meeting minimum requirements
- We may modify DashPass benefits with notice to subscribers
6. Cancellations and Refunds
Orders may be canceled before the restaurant begins preparation. Once preparation starts, cancellation may not be possible or may result in partial charges.
Refunds or credits may be issued for:
- Missing or incorrect items
- Food quality or safety issues
- Significantly late deliveries beyond our control
- Orders that could not be fulfilled
7. User Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Harass, abuse, or threaten Dashers, restaurant staff, or other users
- Provide false information or create fraudulent accounts
- Attempt to manipulate pricing, promotions, or referral programs
- Interfere with the proper functioning of the Service
- Use automated systems to access the Service without permission
8. Intellectual Property
All content, trademarks, logos, and intellectual property on the Service are owned by FoodDash or our licensors. You may not copy, modify, distribute, or create derivative works without explicit permission.
9. Limitation of Liability
To the maximum extent permitted by law, FoodDash shall not be liable for:
- Food quality, preparation, or safety (restaurant responsibility)
- Allergic reactions or foodborne illness
- Indirect, incidental, or consequential damages
- Loss of data, revenue, or business opportunities
- Actions of Dashers beyond our reasonable control
10. Dispute Resolution
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law. You agree to waive the right to participate in class action lawsuits.
11. Termination
We may suspend or terminate your account at any time for violation of these Terms or for any reason at our discretion. You may close your account at any time through account settings or by contacting support.
