Terms of Service

1. Acceptance of Terms
By accessing or using ServerWatch ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
2. Description of Service
ServerWatch provides infrastructure monitoring, application performance monitoring, log management, and related observability services. The Service includes the ServerWatch web application, APIs, agents, and related documentation.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use.
4. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to other accounts or systems
- Interfere with or disrupt the Service or servers/networks connected to it
- Reverse engineer, decompile, or disassemble the Service
- Use the Service to monitor infrastructure you do not own or have authorization to monitor
- Resell or redistribute the Service without written permission
5. Payment & Billing
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account.
6. Data Ownership
You retain all rights to the data you send to ServerWatch. We claim no ownership over your monitoring data, logs, or metrics. We use your data solely to provide and improve the Service as described in our Privacy Policy.
7. Service Level Agreement
Pro plans include a 99.9% uptime SLA. Enterprise plans include a 99.99% uptime SLA. If we fail to meet the applicable SLA, you may be eligible for service credits as described in our SLA documentation. The SLA does not apply to scheduled maintenance windows.
8. Intellectual Property
The Service, including its design, features, and content, is owned by ServerWatch, Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works based on the Service.
9. Limitation of Liability
To the maximum extent permitted by law, ServerWatch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
10. Termination
Either party may terminate the agreement at any time. Upon termination, your access to the Service will cease and your data will be deleted after 30 days. We may terminate or suspend your account immediately if you violate these terms.
11. Governing Law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
